retweet@ terms and conditions

The retweet@-website and retweet@-sidebar, -widgets and -softwaretools are products and services of SumtnSumtn UG (haftungsbeschränkt), Kreuzweg 25, 58099 Hagen, Germany („retweet@“).

By using the retweet@ web site and the provided retweet@-sidebar and delivered software tools („service“) you agree to be bound by the following terms and conditions („terms of use“).

By using this service you agree to the terms and conditions of Twitter, Inc. which can be found on the website http://twitter.com/tos and the privacy policy on the web site http://twitter.com/privacy. The following terms of use extend the terms of use of Twitter, Inc. for retweet@ needs as the retweet@-service makes use of the Twitter application programming interface („API“). In those points in which this terms differ from the above mentioned Twitter terms of use this retweet@ terms are valid for our service.

1. This service is provided free as is without warranty.
2. All messages that are posted and send to the Twitter-service using the retweet@-service are stored on retweet@-systems.
3. Despite the above mentioned Twitter terms of use the messages that are send by using the retweet@-service are stored permanently and accessible by the public, except the user deletes the messages that were sent over retweet@-service by hand. This can be done in the interface. If the users Twitter-account is no longer active, retweet@ will remove all messages from the retweet@-service and our softwaretools if the user asks retweet@ to do so. This can be done by sending an eMail with the already deleted Twitter-username to delete@sumtnsumtn.com. Please note that in any way all messages are still stored in our systems for legal issues. After removing they will only no longer be visible to the public in any of our softwaretools and services.
4. By using the retweet@-service the user accepts that his messages are:
   1. stored by retweet@
   2. published on retweet@-partner websites
   3. aggregated with other messages
   4. beeing listed and shown to the public in relation to the website on which the user used the retweet@-service, even if the user has protected his updates on Twitter
   5. made searchable by retweet@
   6. may be deleted at any time
   The messages are sent including a link to the website on which the user used the retweet@-service. We reserve the right to modify these links, while trying to retain the destination as good as we can.
5. retweet@ creates short URLs of website addresses under the domain ort.sh.
6. Resolving of this URLs is only allowed via the retweet@ web-services. It is forbidden to store ort.sh-URLs along with the resolved URL's in databases or to keep it in caches for longer than 48 hours.
7. We reserve the right to modify or terminate the retweet@-service for any reason, without notice at any time.
8. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via a hint in our sidebar, softwaretools and website.
9. retweet@ undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement that we receive and we will remove content that has been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
   1. A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
   2. A description of the copyrighted work claimed to have been infringed;
   3. A description of the infringing material and information reasonably sufficient to permit retweet@ to locate the material;
   4. Your contact information, including your address, telephone number, and email;
   5. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
   6. A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
